Former House Speaker Thomas (Tip) ONeill once said, As it is now, there are four parts to any campaign: The candidate, the issues of the candidates, the campaign organization, and the money to run the campaign with. Without money you can forget the other three. In 2008 Barack Obama became the first candidate since the system was established to refuse those public funds. The presidential campaigns spent 1.3 billion dollars in 2008 a figure close to double what was spent in 2004. In 1976 (the first publicly funded campaign) the candidates spent less than 67 million. In the 2016 Presidential race the candidates raised $1.5 billion and super PACs supporting them raised $618 million. We tend to be extremely cynical about the role of money in political campaigns. Its common to hear people say all politicians are crooks and you cant get anywhere politically without money. Im not about to tell you otherwise but that kind of dismissal of politics and politicians can be very dangerous. If you are convinced its about money and you dont have money the only conclusion is you are powerless. Initiatives Eligible for 2018 General Elections History of California Initiatives According to a brief statistical review of the history of the California State Initiatives, there have been many changes from 1912 through 2018 to date. These changes include various initiatives and their yearly summary, initiatives voted into law and data summary during the change process. For instance, there was no ballot numbering until the 1914 general elections. It is worth noting that before 1960, initiative measures only appeared on the general election ballots. However, initiatives started to appear on primary, general, and special election ballots between 1960 and 2011. According to Chapter 558 of the Senate Bill 202, initiative measures will again appear on the general election ballots from July 2011. New measure eligible for California’s November 2018 Ballot The initiative for a new measure in the constitutional amendment to the new requirements for California’s November 2018 ballot eligibility was expanded for supermajority approval to enact new revenue measures. California Secretary of State Alex Padilla declared that the initiative was eligible for the 2018 General Election Ballot. It is imperative to note that the initiative could only qualify through random sampling of petition signature if the sampling process showed numerous valid signatures, more than 110 percent of the required number. Because the initiative needed at least 643,948 valid voters to be projected, the state secretary announced that the initiative exceeded the required threshold and qualified by way of random sampling. In other words, the initiative constitutional amendment met the supermajority approval for the enactment of the new revenue measures in the 2018 elections. It will also address how the California Secretary of State, in June 2018, certified the initiative as qualified for the November 2018 ballot. Since the initiative needed at least 643 948 signatures to go though the random sampling, the initiative remained valid because the proponent did not withdraw the initiative pursuant to Section 9604 (b) of the Elections Code. Statutory/Constitutional Changes that would occur if voters approved this initiative Private Sector Emergency Ambulance Employees will remain on-call during work breaks. If the new law is approved, there will be statutory and constitutional change following the passing of the new revenue initiative by voters because the labor laws and regulations that entitle employees to hourly meal and rest breaks without being on-call will be scrapped. It had been established that many employees abuse the call-free meal and rest breaks to the detriment and liability of employers. Therefore, making the call-free meal and rest break inapplicable to ambulance employees in the private-sector emergency will enable employers to save unnecessary liabilities with abusive employees. In other words, the new changes will exempt employers from the burden of existing liabilities for employees breaking existing work break laws. Employers in California faced burdensome expenses from the Worker’s Compensations Act, compelling them to reward employees on break without putting them on call, which made the wage bill balloon for private ambulance employers to create losses. Another change that would occur if voters pass this initiative is that employers will be compelled to pay for employees to attend emergency training in violence prevention, incidents, mental health, and wellness. Because the emergency response is an essential aspect of ambulance services, the law proposed that employers commit to paying for emergency training to gain the necessary knowledge, skills, and expertise on matters emergency. One of the main areas of training focuses is violence prevention. Employees would get skills to handle emergency incidents such as fire response, disaster management, accident response, and other life-threatening scenarios. The second area of employee training is violence prevention, focusing on gaining skills in conflict resolution, effective communication, and emotion management. The last area of employee training would focus on mental health and wellness. Under this area, ambulance employees would gain useful skills in handling stress management, anger management, healthy eating and living, healthy thinking, social support, and problem-solving. Overall, the new changes would ensure that private ambulance employers settle their potential employees’ training fees. The new law will also compel employers to create and employ a certain number of employees with mental health issues. According to the United States Disability Act (ADA), employers are prohibited from discriminating against persons with disabilities in employment, public accommodations, transportation, and communications and access to state and local government services. The new changes will put a statutory mandate on employers to employ a given number of persons with mental health disabilities to observe workplace diversity. That would also ensure that the private sector participates in the national campaign of eradicating discriminations against people with disabilities in the country. Changes in Finance, Revenue Measures and Fiscal Management If approved by Legislature’s two-thirds supermajority, the new changes will ensure that the revenue measures widen the definition of state taxes. The local governments will require two-thirds of the electorate approval for the governing body to raise new taxes or fees. The law will also demand states and local governments enacting the new tax laws to explain how revenue will be spent for a better fiscal understanding. Besides, the new law will enhance the legal threshold for local and state governments to prove that any fees will not become taxes unless passed with a two-thirds majority’s approval. In that lens, the law will invalidate 2018 imposed local taxes unless they meet the newly adopted criteria. According to the summary estimate by the Legislative Analyst and Director of Finance of fiscal impact on state and local government, the new changes will cause a fall in the local government’s net savings. According to the analyst, the new changes will cause a sudden decrease in the tens of millions of dollars in savings because of the reduced costs of emergency ambulance contracts. Being the state with the largest population and third-largest landmass in the United States, the state is prone to high cases of floods, wildfires, earthquakes, and other forms of natural disasters. In that context, the law observed the need to create a robustly trained ambulance workforce to participate in the emergency to survive and manage such disasters.
